FINAL NOTICE OF INTENT TO LEVY – Critical information

If you received an IRS “Final Notice of Intent to Levy” letter, it’s a big deal and extremely time sensitive (30 days). The big deal is that if you do not file an appeal, the IRS will garnish your wages, levy your bank accounts, and can even seize your other treasured possessions. RVs, ATVs, cars, boats, and anything else of value are all fair game. But the worst is the wage levy / bank levy combo. This is where the IRS takes the money from your bank account and then garnishes your wages. This puts you in a bad situation, you don’t have any money and no hope of money coming in to replace it. The IRS will generally have a lien on your house at this point, so when the bank forecloses on your home they are in line to get paid.  They know this.

The good news is that you can stop the IRS dead in their tracks by filing an appeal. The appeal rights that come with a Final Notice of Intent to Levy are the best available in IRS collection matters. This powerful appeal, as a matter of law, will force the IRS to stop any levy from happening and force them to consider alternatives that aren’t so harsh. It even comes with the ability to have the tax court take a look to see if the IRS has been unreasonable. I know it’s unlikely that you will take the IRS to the tax court, but the appeals agent is required to factor in that you COULD. This alone leads to better solutions than you would get otherwise.

But this is an extremely time sensitive process. If you miss the 30-day IRS deadline to file the appeal, you forever lose your right to file one. The 30-day deadline is set by LAW, so it cannot be extended. Be super careful, more than once I have met people where the agent agreed to extend the deadline but was being deceptive. The agent was lying about it being able to extend the deadline, and after the deadline passed the agent was then free to levy and garnish. There was nothing the person could do to get the appeal reinstated. If you miss this critical IRS deadline, you are at the mercy of the IRS. The IRS isn’t known for mercy.

The IRS announced that they are going after the big national IRS resolution chains criminally for how they are bilking clients out of big dollars with no results. They have announced as a top priority to prosecute criminals and shut down these unscrupulous businesses.

Even in their advertising many will deceive you by looking like something they are not. They will buy a company, say a bookkeeping service, that was around for a long time. Once they buy this business (that never did IRS resolution), they will claim they’ve been in business for decades, when in fact, many of them are very recent newcomers to the scene that have little real IRS resolution experience. Sounds great that they’ve “been in business for 60 years”! But many are using this as a way to get into the door so you trust them when you really shouldn’t.

Many use “closers” to sell you their service. These salespeople are not licensed professionals and do not have the training or knowledge necessary to truly guide you to a solution. But they are well trained on getting checks from you.  Especially if you believe they’ve been doing it for decades. 
They say you will meet a licensed professional, and you will. But ONLY AFTER you paid a salesperson a big commission. They do not tell you that they are not licensed. Then you will be sent to a “professional” to do the work. You have no idea how much experience this person has, and it doesn’t matter as you already paid a big check. Even worse, they get a commission as well if they upsell you.
