HOW LONG DOES THE IRS HAVE TO COLLECT TAXES

Generally, the IRS has 10 years from when a return is filed to collect a tax. It’s called the Collection Statute of Limitations (CSED). It is set by law, so the IRS MUST abide by this 10-year window. The 10-years may be extended if you do certain things that allow them to, such as filing bankruptcy, certain appeals, and various other items. Once the Statute of Limitations expires, the tax irrevocably goes away, the IRS is no longer able to collect the tax. So much so, in fact, that if you send them a check to pay toward an expired tax, the IRS will send your money back. They simply don’t have the ability to apply it to a tax that has expired under the Collection Statute of Limitations. The video Todd mentions here is being careful about choosing an 800 number claiming to be an IRS resolution firm. The IRS has listed these bogus IRS resolution firms in their “Dirty Dozen” (the IRS name, not mine), as the 12 biggest frauds of the year that they are launching a campaign to prosecute CRIMINALLY. If the IRS does this to the company you paid, it’s very unlikely that you will ever see your money again. It is certain that you will not get a solution.
